Terms of Service

Welcome to Crealix. These Terms of Service ("Terms") govern your access to and use of the products, websites, and AI generation tools provided by Crealix AI ("Crealix", "we", "us"). By creating an account or using the Services you agree to these Terms.

1. Eligibility

You must be at least 13 years old — or the minimum age required in your jurisdiction — and able to form a binding contract. If you use the Services on behalf of a company, you represent that you have authority to bind that company.

2. Your Account

You are responsible for your account credentials and for all activity under your account. You can sign up with email + password or with Google Sign-In. Notify us via our contact form immediately if you suspect unauthorized access. We use Cloudflare Turnstile on authentication forms to deter automated abuse.

3. Subscriptions, Credits, and Billing

Crealix runs on a credit system. Generations (images, videos, voiceovers, music, motion clips) consume credits. Payments are processed by Stripe.

• Subscriptions: monthly and yearly plans renew automatically at the start of each cycle. Each renewal tops up your plan credits; unused plan credits do not roll over and expire at the end of the billing period.
• Top-up credits: one-time credit purchases. Top-up credits do not expire and are consumed after your plan credits for the cycle.
• Gifted credits: credits granted for promotions or support resolutions are tracked separately and may carry their own expiry.
• Upgrades and downgrades: upgrading adjusts your credit balance immediately. Downgrades apply at the next billing cycle; credits already granted are not clawed back.
• Automatic credit refunds: when a generation fails due to an error on our side, the reserved credits are automatically refunded to your wallet.
• Cancellations: you can cancel a subscription at any time from Settings → Billing. Cancellation stops future renewals; you keep access and remaining plan credits until the end of the current period.
• No refunds: fees already paid are non-refundable, as described in our Refund Policy, except where required by law.
• Prices may change; changes only apply to future billing periods and you will be notified in advance.
• You are responsible for applicable taxes and for keeping your payment details current.

4. Acceptable Use

You agree not to:

• Use the Services to generate or distribute illegal, infringing, defamatory, or harmful content.
• Create sexual content involving minors or non-consensual intimate content.
• Produce deceptive impersonations of real individuals, or content that promotes violence, hate, or harassment.
• Attempt to reverse-engineer, interfere with, or overload the Services, or bypass usage limits, Turnstile checks, or security controls.
• Use the Services to train a competing machine-learning model or scrape outputs at scale.
• Share credentials with unauthorized users or attempt to pay via chargeback after services are rendered.

Violations may result in suspension, termination, credit forfeiture, and — in serious cases — a permanent block on your email from re-registering.

5. User Content and License

You retain ownership of the prompts, scripts, uploads, and other inputs you submit. You grant us a worldwide, non-exclusive license to host, process, transmit to our AI inference providers (fal.ai, ElevenLabs, OpenRouter) and display your content solely to run the Services, deliver your generations, and provide support.

Subject to your compliance with these Terms and applicable law, outputs you generate with the Services are yours to use, including commercially. You are responsible for ensuring that your prompts, uploads, and uses of outputs comply with all applicable rights (including rights of third parties portrayed in reference images) and regulations.

6. Intellectual Property

The Services — software, proprietary pipelines, Crealix models and presets, trademarks, and branding — are owned by Crealix and its licensors. Except for the limited license to use the Services, no rights are granted to you.

7. AI-Generated Content Disclaimer

The Services use AI models that can produce inaccurate, biased, or otherwise objectionable results. Review outputs before you publish them. You are responsible for how you use any generated image, video, voiceover, music, or motion clip.

8. Third-Party Services

The Services integrate with third-party providers that are essential to delivery: fal.ai (AI inference), ElevenLabs (voice, via fal.ai), OpenRouter (retention assistant), Stripe (payments), Resend (email), Cloudflare R2 (storage), and Cloudflare Turnstile (bot protection). Your use of those services is also governed by their own terms, which we do not control.

9. Termination and Account Deletion

You may delete your account at any time from Settings → Security. Deletion is irreversible: we soft-delete the account, remove your generated media and uploaded assets, retain billing records for the period required by law, and block the email from self-registering in the future. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if the Services are discontinued.

10. Disclaimers

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. We do not warrant that the AI providers we rely on will be available at all times or that any specific generation will succeed.

11. Limitation of Liability

To the maximum extent permitted by law, Crealix will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our aggregate liability for any claim arising out of or relating to the Services will not exceed the greater of (i) the amount you paid us in the 12 months preceding the claim, or (ii) USD 100.

12. Indemnification

You agree to indemnify and hold harmless Crealix from any claims, damages, liabilities, and expenses arising out of your use of the Services, your User Content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws applicable to the operator's jurisdiction, without regard to conflict-of-law principles. Any disputes will be resolved in the competent courts of that jurisdiction, unless otherwise required by local consumer-protection laws.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Effective as of" date and, for material changes, provide prominent notice. Continued use of the Services constitutes acceptance of the updated Terms.

Affiliate Program

Any user with a Crealix account can opt in to the Crealix Affiliate Program. By activating your affiliate link in the dashboard you accept the additional terms in this section. If you do not activate the program, none of these terms apply to you.

Commissions

We pay 30% of the net amount Crealix actually collects on every paid subscription billed to a user you referred, for as long as that user remains a paying subscriber. Commissions accrue per invoice and are credited to your available balance the moment Crealix successfully receives the payment from Stripe. Free trials, prorations, taxes, and one-time top-ups are excluded.

Payouts

Payouts are made via Stripe Connect Express and require you to complete Stripe's identity and bank-account verification (KYC). Once your available balance reaches the minimum threshold (currently $50 USD), Crealix automatically initiates a payout on the 1st of each month. You may also request an instant payout at any time when your balance meets the threshold.

Reversals

Crealix does not issue voluntary refunds on subscriptions; subscribers may only cancel future renewals. In the rare event a charge is reversed by the customer's bank (chargeback), by Stripe (fraud or risk decision), or by an ACH return, the commission tied to that invoice is automatically rolled back. If a reversal happens after the corresponding payout has already been sent, the resulting negative balance is offset against future commissions.

Acceptable promotion

You may promote your affiliate link on owned channels (websites, blogs, newsletters, social media accounts you control) and through paid advertising on Google, YouTube, Meta, X, and similar networks. You may NOT bid on Crealix-branded keywords in search advertising, impersonate Crealix, run misleading creatives, post on platforms that prohibit affiliate links, send unsolicited bulk email, or create bot/synthetic accounts to trigger commissions. Self-referral (using your own link to subscribe a Crealix account you control) is not eligible.

Termination

Crealix may suspend or terminate your participation in the Program at any time for breach of these terms or for fraudulent activity, in which case unpaid commissions tied to fraudulent activity may be voided. You may leave the program at any time from your dashboard; previously earned commissions remain payable subject to the rules above.
